The Testament Testamentary and Inventory of Christian Steuart in Port-an-eilean, 1741

Christian Steuart The Testament Testamentary and Inventory of the debts and sums of money which pertained and was resting to the deceased Christian Steuart in Port-an-eilean, only child procreated betwixt the decease Alexander Steuart, in Balchapel of Borenich, and Elspeth Steuart, thereafter spouse to Alexander Steuart in Port-an-eilean, the time of her decease which was in the month of (blank) 17(blank), faithfully made and given up by the said Elspeth Steuart, her mother, executor testarix, nominated and appointed by her, conform to her latter will and testament of date the 26th day of April 1730 year, whereof the tenor as subjoined.

Imprimis (firstly) there is given up, pertaining and resting to the said defunct, the time foresaid of her decease, the sum of sixty merks by Duncan Steuart in Chamberbane, laying in the hands of Donald Steuart in Balnabodach, her (cousin?) per bill of date (blank) .

Item, the sum of twenty merks resting by (John?) Steuart in Chamberbane.

Follows the latter will and testament:

I, Christian Steuart in Port-an-eilean, only child procreated and existing betwixt to now deceased Alexander Steuart of Balchapel of Borenich, and Elspeth Steuart, now spouse to Alexander Steuart in Port-an-eilean, being perfect in memory and judgement, although sickly and infirm in body, and to prevent any strife or dispute that may happen to arise after my death, betwixt my relations about my (executory?) goods, I hereby make my latter will and testament as follows:

In the first place I leave my soul to God Almighty, my Creator, hoping to be save by the merits of Jesus Christ my blessed Redeemer, and will my body after death to be decently buried.

Item, I leave, nominate, appoint and ordain the said Elspeth Steuart, my mother, to be my only executor and sole legator and un....able intromellor ...d my whole moveable goods, gear, debts and sums of money due to me being by bond, bill or otherways and in cash ........ foresaid pertaining and belonging to me at my decease, I give full power to give up inventory thereof conform the same as use is to defray any funeral, pay my just and lawful debts and to use and dispose upon the remainder as her own proper means in time coming and secluding and debarring my nearest in kin and all others who may pro...d to be my executors. And finally I appoint and ordain this to be my latter will and testament in all time coming hereby revoking, annuling and recalling any former latter wills and testaments and legacies, if any be made and subscribed by me preceeding the date hereof. And for the more security I consent to the registration hereof in the Books of Council and Session or any competent therein, to remain for preservation or if need be therein all ex...? needful may pass hereon as (effect?) and constitute. In witness whereof I have subscribed these present written by Neill McGlashan, write in Clune, at Port-an-eilean, the twenty sixth day of April 1738 years. Before these witnesses: William McGlashan in Tressait and (Patrick?) McGlashan, son of the said Neil McGlashan (rest in Latin with signatures of witnesses). This testament was confirmed at Dunkeld the twenty-seventh day of June 1741 years by James Bissat, Commissary, and Charles Steuart of Bohally became bound cautioner for the executrix.
